Contractors have been seeing their modifiers rise regardless of good loss history due to the relative experience in Texas.  Texas contractors are working safer and having fewer claims overall.  This lowers the expected claims and can increase your modifier even though you have not had any accidents.    Read more

Final Rule Released Concerning Summary of Benefits and Coverage (SBC)

Some of the most hotly anticipated Obamacare regulations were released last week: the rules relating to the Summary of Benefits and Coverage and Uniform Glossary requirements.  These rules are especially important to self-funded or self-insured plans because they will have the responsibility for preparing the materials that comply with the regulations.  For fully insured plans, the paperwork will be the responsibility of the insurance carrier.

HHS Denies Texas' Appeal on MLR Rules

If you are an avid reader of the Dec Page, you are aware of the impending Medical Loss Ratio (MLR) rules requiring that health insurance carriers spend at least 80% (for small groups and individuals) or 85% (for large groups) on claims and limiting their overhead costs to no more than 20% or 15% of their revenue.  Read more

Texas Supreme Court Impacts Employers Relying on Temporary Staffing

Rafael Casados was placed as general laborer for Port Elevator in Brownsville.  Mr. Casados worked for StaffForce, Inc. a temporary staffing agency.  Three days into his stint with Port Elevator he was killed while working in a grain elevator.  Both Port Elevator and StaffForce has workers compensation insurance.  Mr. Casados' position as a temporary worker is not unusual and is common place throughout Texas, especially in construction.  Read more
